Liability in respect of dog ownership

Following the entry into force of Spain’s new Protection of Animal Rights and Welfare Act 7/2023 of 28 March, dog owners now have to take out and maintain liability insurance.

To ensure your policy can continue to provide this cover without an increase in the premium, section 3.17 - Public liability as owner of domestic animals in the terms and conditions of your policy has been amended, maintaining the cover exclusively for dogs which prior to the entry into force of Act 7/2023 did not need compulsory liability insurance as they were not considered potentially dangerous dogs*.

From 29 September 2023 and for as long as this requirement remains in effect, cover is provided for damage or injury to third parties caused by a dog that is not potentially dangerous under the terms established in your policy and according to applicable regulations. This is on condition that the dogs are kept for the purpose of companionship and not used for commercial activities; comply with vaccination and/or safety standards regulations; live in the insured home, and are the responsibility of the policyholder or insured in your policy whose details are shown in the schedule.

Liability arising from injury or damage caused in the following cases is excluded:

a) Potentially dangerous dogs*, dogs used for commercial, professional or illicit purposes.

b) When the policyholder or the insured does not comply with the rules and requirements set out in the regulations for dog ownership.

The sum insured will be the one shown in the Liability cover in the schedule.

The term of this cover is also tied to the term of the policy.

 

* Prior to the new Act 7/2023 of 28 March, section 3(1)(d) of Royal Decree 287/2002 implementing Act 50/1999 of 23 December on legal arrangements for owning potentially dangerous animals required owners of these animals to provide proof of having taken out liability insurance for injury or damage to third parties.
